Pandering & Pimping Charges in Oklahoma – Law & Help | Attorney

Pandering & Pimping Definition Oklahoma

pandering laws in oklahomaPandering (also known as pimping) occurs when someone:

  • Procures someone else for prostitution;
  • Causes, induces, persuades, or encourages another to become a prostitute through promise, threats, violence, or any other device or scheme;
  • Procures someone to be placed in a house of prostitution for another person
  • Causes, induces, persuades, or encourages someone in a house of prostitution to remain there through promises, threats, violence, or any other device or scheme;
  • Procures another person to become a prostitute through fraud, artifice, or duress;
  • Procures another person to enter a place where prostitution is encouraged through fraud, artifice, or duress;
  • Procures another person to enter Oklahoma or leave Oklahoma for the purpose of prostitution through fraud, artifice, or duress;
  • Procures another person to become a prostitute within Oklahoma through fraud, artifice, or duress;
  • Receives, gives, or agrees to receive or give any money or thing of value for procuring or attempting to procure someone to be put into a house of prostitution within Oklahoma or enter or leave Oklahoma for the purposes of prostitution.

It’s no defense to this crime that any part of the above acts took place outside Oklahoma. Marriage is no defense to this crime.

Any female involved in the above activities will be considered a competent witness in any prosecution under this law. They may testify for or against the accused as to any transaction, any conversation with the accused, or any conversation by him with anyone else in her presence. This is regardless of her marrying the accused before or after a violation of this law, whether called as a witness during the existence of the marriage or after its dissolution.

Punishment For Pandering & Pimping in Oklahoma

This crime is a felony. The range of punishment in prison is 2-20 years. For a first conviction, the range of fine is $1,000-$3,000. For a second conviction, the range of fine is $3,000-$6,000. The range of fine foa a third and subsequent conviction is $6,999-$9,000.

Unlawful Restraint of a Female in a Prostitution House

It’s illegal to:

  • Keep, hold, detain, or restrain against her will, any female in a place where prostitution is practiced or allowed;
  • Directly or indirectly keep, hold, detain, or restrain or attempt to keep, hold, detain, or restrain, a female in any place where prostitution is practiced or allowed by any means for the purpose of compelling such female, directly or indirectly to pay, liquidate, or cancel any debt, dues, or obligations incurred or said to have been incurred by that female

This crime is a felony. The range of punishment in prison is 2-20 years. The range of fine is $300-$1000.

Owner or Proprietor Permitting Pandering

It’s illegal for any owner, proprietor, keeper, manager, conductor, or other person to knowingly permits or violates Oklahoma’s pimping law in any house, building, room, tent, lot, or premises under his or her control or of which he or she has possession.

A first offense is a misdemeanor. The range of punishment in jail is six months-one year. The maximum fine is $300. A second and subsequent offense is a felony. The range of punishment in prison is 1-10 years.
