How Public Is A DUI Or DWI Arrest And Prosecution?

DWI Arrest And ProsecutionHow public a DUI or DWI arrest and prosecution will be depends on which agency made the arrest and who is prosecuting the case. Much of how public an arrest will be depends on whether or not you are being charged by a city, which as of November 1, 2016 has to be a court of record, or by a county.

Currently, only Oklahoma City and Tulsa are courts of record. Beginning November 1, 2016, if you are arrested for DUI in any city other than Oklahoma City or Tulsa, it will be charged in the county where the arrest occurred. The reason why it’s important to know the difference between a charge in a county and the city is that if it’s charged in the county, the information goes public. Oklahoma has a very open system of court proceedings. Anybody can get on the internet and search the Oklahoma State Court Network (OSCN) at If you know the person’s name and birthday, you can then find their case. You can download many of the documents filed in cases. Some counties even let you download the probable cause affidavit, which is kind of like a mini police report. Needless to say, that information can get out to the public very quickly. However, any charges filed by a city, even Oklahoma City and Tulsa, are not put on OSCN.

The real difference between the courts of record and the courts not of record is that a court of record shares the DUI arrest with the county. If someone is arrested for a DUI after that, the county will know that that subsequent arrest should be charged as a felony.

Is There A Typical DUI Or DWI Client That You Tend To See More Of?

Generally, there is not a typical DUI or DWI client. I see cases varying from underage DUI arrests up to people who are approaching senior citizen level and everything in-between. With the University of Oklahoma and several other universities nearby, it’s very typical to have college-age students arrested for DUI or DWI. But in general, the type of arrests spans the entire spectrum of people that could possibly be arrested and that being equal numbers of male and female.
