Basic Domestic Assault and Battery (First Offense)
Under 21 O.S. § 644(C), a first conviction for domestic assault and battery is a misdemeanor, punishable by:

Up to 1 year in county jail, and/or
A fine up to $5,000
A second or subsequent offense becomes a felony, carrying up to 4 years in prison.

Types of Domestic Assault and Battery in Oklahoma
Oklahoma law defines several enhanced or aggravated forms of domestic abuse, depending on the alleged conduct, injury, or victim’s status.

Here are the main types of domestic assault and battery offenses prosecuted in Oklahoma:

1. Domestic Assault and Battery by Strangulation or Attempted Strangulation (21 O.S. § 644(J))
This involves intentionally impeding another person’s breathing or blood circulation by applying pressure to the throat or neck.

1 to 3 years in prison for a first conviction
Up to 10 years in prison for subsequent convictions
2. Domestic Assault and Battery with a Dangerous Weapon (21 O.S. § 645)

Penalties:

Felony offense
Up to 10 years in prison
3. Domestic Assault and Battery Resulting in Great Bodily Injury
Charged when the alleged victim suffers serious or lasting injury, such as broken bones or internal trauma.
Penalties:

Felony offense
Up to 10 years in prison
4. Domestic Assault and Battery in the Presence of a Child (21 O.S. § 644(G))
Applies when the alleged act occurs in front of a minor.
Penalties:

5. Domestic Assault and Battery Against a Pregnant Woman
Charged when the alleged victim is known to be pregnant.
